SPORT PARTICIPATION RELEASE OF LIABILITY, WAIVER OF CLAIMS, EXPRESS ASSUMPTION OF RISK AND INDEMNITY AGREEMENT FOR LET’S GO SURF SCHOOL
Please Read and make sure you understand the implications of signing. By checking here, you are consenting to the use of your electronic signature in lieu of an original signature on paper. You have the right to request that you sign a paper copy instead. By checking here, you are waiving that right. After consent, you may, upon written request to us, obtain a paper copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with us for any document will continue until such time as you notify us in writing that you no longer wish to use an electronic signature. There is no penalty for withdrawing your consent. You should always make sure that we have a current email address in order to contact you regarding any changes, if necessary.
I, for myself and on behalf of my heirs, assigns, personal representatives, next of kin and whomever else may have an interest either at common law or by operation of statute, hereby release, waive, relinquish, discharge and covenant not to sue LGSS, LB Entertainment, Carlos Zavala, Bolsa Chica State Beach and their officers, the city of Huntington Beach and their officers, instructors, advertisers, and if applicable, owners and lessors of premises used to conduct the LGSS activity (“Releasees”), from liability from any and all claims for any and all injury, disability, death, or loss or damage to person or property, whether arising from the negligence of the releasees or otherwise, sustained as a result of, arising out of or related to any LGSS activity, to the fullest extent permitted by law. In consideration of being allowed to participate in any way in one or more Let’s Go Surf School (LGSS) classes, surfing, and other water sport lessons, programs, related events and activities (referred to herein as a “LGSS Activity” or “LGSS Activities” as the context requires), I acknowledge, appreciate, and agree that:
General
LGSS Activities are inherently risky and potentially dangerous. The risk of injury from many of the LGSS activities is significant, including the potential for permanent paralysis and death, and while particular skills instruction, equipment, and personal discipline may reduce this risk, the risk of serious injury to the head, neck or spine; drowning; injury to muscles, bones, ligaments, tendons and other connective tissues; injury to internal and external organs, loss of or damage to sight, hearing, or teeth; long or short term disability; loss of income, career opportunities or the enjoyment of life; and pain, scarring and/or disfigurement. The causes of possible injury are many, including but not limited to: injury from contact with water, waves, sand, rocks, coral, equipment, other persons, submerged or partially submerged objects; water inhalation; injury from bodily contact, incidental to or inherent in the nature of the activity; slipping and falling or tripping on surfaces, regardless of physical or environmental conditions; entanglement with equipment; injury from warming up, practicing or training for participation; injury due to supervision or lack of supervision by LGSS employees or agents, including instructors, or to instructions ( or lack thereof) regarding the use of equipment or tools or to the nature of the activity itself; injury from contact or encounters with animals, stingrays, or plants; negligent or malicious acts of other participants, regardless of whether LGSS had or should have had knowledge of the likelihood of negligent or malicious acts by such participant and other causes that are incidental to or inherent in the nature of the activity.
I ACKNOWLEDGE THAT LGSS RESERVES THE UNRESTRICTED RIGHT TO DISMISS PARTICIPANTS WITH NO REFUND, including but not limited to anyone whose conduct or influence is deemed harmful or hostile, and anyone in violation of rules set forth by “Rules of the Beach.” I further acknowledge that any deposit and/or tuitions are NOT REFUNDABLE FOR ANY REASON, and that being late for a scheduled lesson, class, camp, or orientation may result in me or my child/ward waiting for the next scheduled lesson, class, camp, or orientation.
I GIVE PERMISSION FOR INSTRUCTORS, STAFF, AND EMPLOYEES TO START PRELIMINARY TREATMENT AND CARE, or to arrange transportation for me or my child/ward to a local Emergency Room, in the event that I or my child/ward become ill or injured. In instances when this Agreement is being executed by a parent or guardian, the signor acknowledges that he/ she has the right and legal authority to do so on the behalf of your child/ward.
I understand and acknowledge the contagious nature of COVID-19 and voluntarily assume all such risk that my child and I may be exposed to or infected with the COVID-19 through participation in the Let’s Go Surf School Activities and programs, and that such exposure or infection may result in personal injury, illness, permanent disability and/or death.
Assumption of Risk
I knowingly and freely assume all risks related to or arising out of any LGSS activity, both known and unknown, even if arising from the negligence of the RELEASEES (as defined in the next paragraph) or others and assume full responsibility for my participation.
Release from Liability
I, for myself and on behalf of my heirs, assigns, personal representatives, next of kin and whomever else may have an interest either at common law or by operation of statute, hereby release, waive, relinquish, discharge and covenant not to sue LGSS, the city of Huntington Beach, and their officers, instructors, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used to conduct the LGSS activity (“RELEASEES”), from liability from any and all claims for any and all injury, disability, death, or loss or damage to person or property, whether arising from the negligent of the releasees or otherwise, sustained as a result of, arising out of or related to any LGSS activity, to the fullest extend permitted by law.

This Agreement is for a MINOR
This is to certify and represent to LGSS that I am the parent/guardian with legal responsibility for this minor participant and that I have legal authority to sign this agreement. I have read this assumption of risk, release of liability and indemnification agreement and full understand ins terms. I acknowledge that surfing and other LGSS Activities may be dangerous and I accept and assume such risks. I consent and agree to the minor participant’s assumption of risk, release from liability and indemnification as provided above of all the RELEASEES, and on behalf of myself, the minor participant, my heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the RELEASEES from and all liabilities incident to the minor participant’s involvement or participation in an LGSS Activities as provided above, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES, to the fullest extent permitted by law. I agree to indemnify defend, save, and hold harmless the RELEASEES from and against any all all claims, demands, liabilities, damages, actions, causes of actions, losses, injuries, costs.
HEREBY UNDERSTAND AND AGREE PHOTOS AND VIDEOS OF MYSELF OR CHILD/WARD MAY BE TAKEN AND USED FOR WEBSITES, COMMUNICATIONS, PROMOTIONAL MATERIALS, ADVERTISING, AND SOCIAL MEDIA, including but not limited to being shared on Facebook, Instagram and Twitter, and via email,, related to LGSS and its associated programs, events, and businesses. I waive and release the use of my photograph, name, and likeness, or the photograph, name, or likeness of my child/ward, for use in any media now known or not known including in video format, for any reason or purpose without compensation to me or others.
